A- MEMORANDUM OF ASSOCIATION |

The Association shall be named as "Akhil Bhartiya Jan Jati Vikas Sangh".

The Headquarter of the Association shifted at Khasra No.555/2 & 556, Village Masudabad, Ranaji Enclave, Najafgarh, New Delhi-110043 from 504, Somdutt Chambers-II, Bhikaji Cama Place, New Delhi-110066. However, the Regional offices of the Association may be established in any part of the country and shall be administered according the rules of the Association.

The objective of the Association shall be:

1.) To develop cooperation, unity and fellow feeling among its members and foster fraternity with other citizens of India.

2.) To create and develop spirit of cooperation among its members to combat socio-economic problems being faced by the tribal by way of promotion of education and forwardness, organizing social- welfare activities, cultural programme, sports activities, seminars, symposia and through any other media.

3.) To preserve and develop art, culture, literatures and common interest of the tribal.

4.) To open information centres with a view to disseminate information and to provide necessary guidance for imparting training, better occupational and employment opportunities in public and private sectors to the tribal.

5.) To create facilities for imparting vocational training to enable tribal youths to avails employment opportunities. 6.) To publish magazines/ newspapers to create awareness on socio- economic, cultural and employment aspects for the welfare of the

tribal.

7.) To establish and maintain Libraries and Information Centres to create facilities for tribal students.

8.) The Association shall refrain from taking part directly or indirectly in any political or anti-governmental activities.

9.) To undertake any other activities connected with the aims and objects of the Society.

4. We, the undersigned are desirous of forming a Society name ‘AKHIL BHARTIYA JAN JATI VIKAS SANGH’ under the Society Registration act XXI of 1860 (Punjab Amendment Act 1957) as extended to the Union Territory of Delhi in pursuance of this Memorandum of Association.

MEMBERSHIP: There shall be two types of membership (a) Life membership and (b) annual membership subject to the following: -

(i) All adult tribal or any other adult citizen of India, residing in India or outside India, are eligible for the membership of the association provided they abide by the rules and regulations of the Association and they have attained the age of 18 years.

(ii) Any person who is eligible to become member of the Association and desires to become member of the Association, shall submit an application in the prescribed form.

(iii) The in para (i) above shall normally qualify for the membership of the association and the executive committee shall admit such applicants by adopting a resolution to this effect. The decision of the Executive committee shall be final in this regard.

(i)

Every person admitted as member shall have to pay

membership fee of Rs.100.00 as annual, membership fee of Rs.1100.00 as life membership fee at the time of joining the Association.

(ii) The membership period shall be the financial year i.e. 1st April to 31st March.

(iii) Each member is required to pay special contributions as and when required by the Executive Committee.

(iv) The Executive Committee shall have right to raise funds as and when necessary and charge additional subscription from members for any individual games, events, activity of function of the association.

Membership will be terminated by the Executive Committee on account of resignation, death and default in payment of the annual subscription and by expulsion on the ground of misconduct. 

The Members who have resigned or whose membership has been terminated for any other reason may be re-admitted on payment of membership fee and on the full satisfaction of the Executive Committee by adopting a resolution to this effect.

(a) The General Body shall consist of all members of the Association and the final authority of the Association shall vest in it.

(b) The functions of the General Body shall be:

(i) To elect the Managing Committee/Executive etc., including office bearers and members by the end of April or May every three year.

(ii) To appoint returning officer to conduct elections of the Executive Committee.

(iii) To amend the constitution of the Association.

(iv) To pass the accounts of the previous year and consider the Auditor's report and annual report.

(v) To approve the programme of activities of the Association for the ensuing year.

(vi) To consider and decide about the merger/amalgamation of other association in this association and merger, amalgamation and winding up of the Association and disposal of assets and liabilities, if any.

(vii) To nominate a body of patrons consisting of as many Members as may be required by the General Body to guide the Executive Committee as and when required.

(viii) To discuss and decide any other item with the permission of the chair.

(c) Meetings:

(i) The General Body shall meet at least once in a year to review and to chalk out further programme of the Association.

(ii) 15 days advance notice shall also be given to the members for the General Body Meeting

(iii) Extraordinary meeting shall also be convened if 1/3rd of the members stationed at Delhi request the President in writing. At least 7 days advance notice shall be given for such extraordinary meetings of the General Body. 

 

(d) Quorum:

(i) The quorum of the General Body Meeting shall be 100 members or 50% of the total members stationed at Delhi, whichever is less. 

(ii) For adjourned meetings, there shall not be any quorum.

 

(e) Powers:

(i) The General Body shall be supreme in all matters concerning the Association.

(ii) The decision of the General Body Meeting shall be taken by simple majority on all matters except; (a) amendment of the constitution and (b) dissolution of the Association in which decision shall be taken by a 2/3rd majority of the members present and voting.

(iii) No TA and DA shall be payable to members for attending the General Body/any other Committee meeting of the Association.

 

(c) Meetings:

(i) The Executive Committee shall meet at least once in a month. A notice of 7 days shall normally be given for such meetings.

(ii) The emergency meetings of the Executive Committee shall be called at short notice.

(iii) The quorum of the meeting shall be 50% of the strength of the Executive Committee.

(iv) In the absence of the required quorum, the meeting shall be adjourned for 30 minutes. In case of adjourned meeting, there shall be no quorum.

(d) Functions:

The Executive Committee shall carry out day to day management of the affairs of the Association and shall have powers to incur expenditure within the funds available with the Association for conducting the activities of the Association. It shall not go in debts for conducting its activities and while doing so the Executive Committee shall be responsible.

i) To hold annual General Body Meeting and implement the decisions of the General Body.

ii) To approve fees and subscription from the members and incur expenditure on behalf of the Association.

To prepare annual reports of the Association to be presented before the General Body.

iv) To maintain assets of Association.

v) To arrange seminars and group discussions on economic, social, literary and current problems.

vi) To arrange General discussion on the topics which might be useful for uplifting of the Tribes.

vii) To arrange social gathering which may help the tribal in social awakening.

viii) To arrange such programmes in rural areas Which will help the tribal population at large.

ix) To enroll new members after verification of the particulars of a desirous person.

x) To appoint auditor.

xi) To undertake any other activities as directed by the General Body and to achieve the objectives of the Association.

(a) President:

(i) There shall be a President of the Association who shall be Executive Head and shall enjoy all powers in all matters of administration and establishment of the Association. The President shall accept resignation(s) of the member(s) of the Executive Committee and fill up the post(s) failing vacant and the President shall apprise the Executive Committee in its next meeting (s).

ii) The President shall preside over all the meetings of the General Body and Executive Committee.

The President shall act as a guide to other members and supervise the execution of the policies and programmes by the Executive Committee.

iv) The President shall have the powers to supervise over the finance of the Association.

v) The President shall have the powers to powers to incur expenditure up to Rs. 2500/- on contingencies and beyond this, subject to approval of the Executive Committee.

vi) The President may delegate all or any of his powers to any of the Vice-Presidents.

vii) The President shall have power to take upon himself any or all the functions of any or all the office bearers or vest such functions on any other member, if a situation for taking such action become inevitable.

viii) The President shall have right to exercise casting vote.

ix) The President shall have powers to nominate / replace arca coordinators as and when required to assist him and inform the Executive Committee in its ensuing meeting.

(b) Vice-President:

Any one of the Vice-Presidents, who was authorized by the President, shall preside over the meetings of the General Body and the Executive committee in the absence of the President. All shall also carry out such functions as may be delegated to them by the President.

(c) General Secretary:

The General Secretary shall:

i) Maintain a register containing the names & address of the members of the Association.

ii)

Issue notice(s) of the meeting(s) of general Council and

Executive Committee in consultation with the President and

record the minutes of the meetings.

Be responsible to the Executive Committee for all activities and will conduct correspondence on behalf of the Association.

iv) Have authority to incur expenditure not exceeding Rs. 1000/- in anticipation of formal sanction by Executive Committee and shall report such expenditure to the Executive Committee for approval in its next ineeting.

v) Submit a report on the working of the Association for the preceding year at the annual General Meeting.

vi) Execute contracts on behalf of the Association as and when authorised to do so by the Executive Committee.

vii) Keep all records (excluding cash & accounts) of the Association.

 

(d) Joint Secretary and Assistant Secretaries:

The Joint Secretaries shall assist the General Secretary in discharge of his/her official duties in such a manner as the President or the General Secretary may direct. Similarly, Assistant Secretaries will be responsible for the work assigned to them separately.

(e) Treasurer and Assistant Treasurers:

He shall be responsible for;

(i) Making all collections and receive cash and give receipts thereof on behalf of the Association and be responsible for the proper maintenance  of Accounts. 

(ii) Keeping proper maintenance of accounts book and other Registers of the Association and post all the receipts & expenditure regularly in the Cash Book and put it up for information to the Executive Committee in its next meeting.   

(iii) To work as Financial Adviser to the President/ General Secretary of the Association.

(iv) (v) To keep cash in hand up to Rs. 1000/- only & to deposit excess funds, if any, in the bank account of the Association. To prepare annual statement of accounts at the end of the

financial year and after approval of the Executive Committee, submit it to the Annual General Body meeting, duly audited along with the auditor's report and replies thereof, if any.

He shall be assisted by two Assistant treasurers.

(f) Editor & Assistant Editors;

The Editor shall be responsible for all publicity works. He will be assisted by two Assistant Editors for discharging his functions.

(g) Executive Members;

(i) Attend Executive Committee Meetings

(ii)Assist the President, Vice-President, General Secretary and Treasurer as needed.

(iii) Other works as identified and needed.

Each state having membership strength of not less then 11 (Eleven) shall form a regional committee. It shall elect a convener who shall carry on the activities in his/her respective state and to act on the direction of the Executive Committee as and when required. The Convener is authorized to form sub-committee in consultation with the President at district level, if needed, for assisting him in discharging the activities of the Association. The regional sub-committees shall meet their own expenditure.

Similarly, in Delhi also the area coordinators / conveners appointed by the President shall carry on activities in his/her respective areas to act on the directions of the president as and when required.

Auditors shall be appointed by the Executive Committee every year for audit of the accounts of that financial year amongst the regular members of the Association (other than a sitting member of the Executive Committee) or from outside. He shall audit the accounts & obtain Clarifications in this regard, if necessary, from The office bearers of the Executive Committee. He shall suitably endorse his report on the Annual Statement, of the Accounts & on the list of assets of the Association etc.

Chief Patron/Patrons shall be

appointed as many as necessary under Para (B) (vii) of Chapter V above. They shall be invited to attend meetings of the executive Committee/General body as special invitees as and when required. They will tender advice on matters raised in such meetings. However, they shall have no voting rights in such meetings.

The Association shall have funds from membership donation, special contributions, additional subscription, and interest on deposits, grants received from Government & non-Government agencies and sponsors.

Funds shall be withdrawn from bank(s) with joint signatures of two persons out of President, General Secretary and Treasurer.

 NCT of Delhi shall be the jurisdiction of the Legal disputes.

The outgoing Executive Committee shall hand over all papers/accounts to the new Executive Committee on or before the first meeting of the newly elected Executive Committee.

XV In case OF THE ABOVE SOCIETY is dissolved it will be merged with any other Society with similar aims and objectives and subject to Section XII and XIV of the Societies of Registration Act.

XVI All the provisions of the Societies Registration Act, XXI of the 1860 (Punjab Amendment Act, 1957) as extended to the Union Territory of Delhi shall apply to the society.
